At the end of March 2023, in the middle of the pension protests, with a comrade, I received a fine for participating in a prohibited demonstration.
That week, the prefect issued order after order of prohibition, changing the perimeters each day. The emergency judge (juge des référés) of the administrative court even ordered the prefect to publish the orders imposing the prohibitions "on the prefecture's website within a timeframe allowing useful access to the emergency judge seized".
Indeed, as with many orders published that week which led the emergency judge to take that decision: the order relied on against me in this case was published on the prefecture's website the day after the date of the prohibition (and of my fine), rendering it illegal.
After contesting it, I was convicted and my comrade acquitted (not the same judges).
Today, the Cour d'appel de Paris has upheld the first-instance decision.
I had been fined 135 EUROS, to which 62 EUROS of Appeal costs have now been added. I will pay them.
A somewhat trivial sum. But I consider that I was convicted on the basis of an illegal order, which profoundly calls into question our freedom to protest.
Given current events, it seems essential to me to exhaust all possible avenues of appeal to denounce this practice of systematically banning our demonstrations.
That is why I must decide whether to bring this to the Court of Cassation by Monday, for which the procedural costs are 422 EUROS.
I will only do so if I manage to raise 422 EUROS. In the event of victory, they will be refunded to me.
I call on those who wish to help me with this appeal.
If the sum is returned to me, I will return the 422 EUROS.
If I am convicted, I will pay the 200 EUROS to which I have already been sentenced on Appeal, and I will return the excess (222 EUROS) proportionally to what each person has contributed (unless some people wish to waive it in favor of other, more precarious donors).
If I do not raise the sum, I will abandon the appeal (unless it is only a little short) and I will refund the amounts given.
