Call to support Dany, a Yellow Vest from the Var, facing judicial repression
Self-employed in the events sector, Dany, 58, was not accustomed to demonstrations, social networks, or the courts.... On April 13, 2019, Dany, mobilized in the Yellow Vests movement for greater social justice, took part in one of her first major demonstrations in Marseille...
A demonstration put particularly under high tension by the police: baton attacks, arrests and tear-gassing from 4 p.m. while protesters were dispersing naturally... That day she was shocked and outraged by the violence of some police officers... Upon arriving at the Vieux Port, she filmed what was happening to show it to her friends from the Var who were not there... her very first live stream… This livestream turned out to be public and was widely commented on and shared....
Summoned several weeks later to the Marseille police station without knowing why, she underwent 30 hours of police custody... and was brought before an immediate hearing... for “insults to persons vested with public authority, threat of a crime or offence against persons or property against a holder of public authority, and incitement to commit a crime or offence that did not materialize by word, writing, image or electronic means of communication.”
The court sentenced her to one year of suspended imprisonment and several thousand euros in fines for the 3 police officers who filed complaints. The judicial harassment does not stop there since her civil trial is forthcoming. One of the officers claims that he and his family have been living in fear since the incident and has requested €10,000 in damages.
Dany appealed the decision and appeared before the Aix-en-Provence Court of Appeal, after 3 successive postponements since 03/2020. Dany was acquitted of the three counts of outrages and found guilty of the second offence "incitement to hatred and to crime without effect"; the damages were upheld and transferred to the second offence, a RARE and incomprehensible fact according to her lawyer — this is called A JUDGMENT OF SOLOMON. It is impossible for her to go to the Court of Cassation or to hire a lawyer in Paris in addition to her own.
Justice, like the police, here act as instruments of a drift, a police state.... From the anti-rioter law of January 2019 to the Global Security bill... a whole series of measures to deprive us of our freedom to protest and to express ourselves..
Let's not hide it: this trial, like others, is a trial set as an example — to break the morale of engaged activists, to destroy future mobilizations, ....
Let's not let this happen, let's not leave anyone alone in the face of judicial repression!
We support Dany and we condemn police officers who abuse their powers! We demand an end to their impunity and that they be held accountable for their actions!
