CotizUp allows users to create online fundraisings to collect money together via www.cotizup.com. These fundraisings can be used for group collections (birthdays, weddings, births, farewell parties, bachelor/bachelorette events, etc.) or donation appeals (humanitarian or solidarity actions, etc.). This privacy policy explains how we collect and process the personal data you entrust to us. Please read it carefully.

1. Who is the data controller for the processing described in this document?

The data controller is CotizUp Limited, headquartered at The Ole Station House, 15a Main Street, Blackrock, Dublin, Ireland.

Please note that only specifically authorized CotizUp employees can access your personal data as part of their assigned duties. Any CotizUp employee with access to your data is bound by strict confidentiality obligations.

2. Who is covered by this privacy policy?

This Privacy Policy applies to any adult who has subscribed to CotizUp services and is capable of consenting to contractual obligations.

3. What data is collected, and under what circumstances do we collect it?

CotizUp uses collected data to manage this contract and, where applicable, to establish aggregated statistics about its users, services, or usage, with such statistics remaining strictly anonymous.

Personal data related to an individual user notably includes identity data (first name, last name, date of birth), phone number, email address, place of residence, postal address, spoken language, currency, passport or identity card number, IP address, and login verification codes. Finally, the user will be asked to provide bank details (IBAN) so their personal bank account can be credited in case of a payout request.

4. Use of cookies

A cookie is a small file that requests permission to be placed on the user's device (computer or mobile phone) when browsing a website. Cookies help provide a better service to the user.

The CotizUp website uses essential session identification cookies. Once users close their browser, the session cookie is simply destroyed. 5. What is our policy regarding minors?

CotizUp services are prohibited for minors under 18 years old or under the legal age of consent for such online services under the laws of the jurisdiction where the person is located.

CotizUp collects proof of customer identity as part of its age-verification process. Any minor found using CotizUp services without legal guardian supervision will have all balances confiscated and their account immediately blocked. CotizUp reserves the right to recheck user information to validate identity and age. Acceptance of this privacy policy authorizes CotizUp to conduct such checks.

6. Who may access your personal data, and how long do we keep it?

CotizUp retains your personal data for the duration of the contractual relationship and for at least five (5) years. Once you terminate services, all your personal data is permanently deleted, except data that CotizUp must retain to meet legal obligations or legitimate reasons.

Once personal data has been submitted, it is securely stored in the CotizUp website database. Email addresses of the user and people whose addresses were entered may be used by CotizUp to send emails related to service use or promotions and information about CotizUp services. The user bears sole responsibility for correspondence sent by email to a person who did not request it and is not registered on CotizUp.

If the recipient wishes to unsubscribe from the recipient list, they can easily do so by sending an email via https://www.cotizup.com/contact.

CotizUp reserves the right to disclose personal data of its customers to public and competent authorities where necessary or required in investigations relating to fraud or misconduct.

Regarding payment management carried out through our payment service provider authorized by the Financial Conduct Authority, this concerns data related to the following purposes:

  • Subscription to services and opening your payment account;
  • Management of payment orders;
  • Execution of card payments;
  • Compliance with legal and regulatory obligations related to anti-money laundering and counter-terrorism financing.

7. How is your data protected?

Access to CotizUp servers and systems where data is collected, processed, and archived is strictly limited. Appropriate technical and organizational precautions have been implemented to prevent access by unauthorized persons, and CotizUp does its best to protect the privacy and personal data of users of CotizUp services. All data transmitted between the user's computer and CotizUp is securely transferred over the internet using encryption. CotizUp uses secure, tested certificates provided by certified encryption authorities.

Furthermore, CotizUp never collects, processes, or stores users' bank card details, which are known only by its banking partner.

8. Can the CotizUp website terminate a contract?

CotizUp may terminate a user's registration, with or without prior notice, at any time and at its sole discretion, subject where applicable to reimbursement of any participation. CotizUp and the user may terminate this agreement at any time. Closing an account by the user constitutes termination of this agreement.

If CotizUp reactivates or reopens a user's account, these Terms of Use will again govern access to and use of the CotizUp website.

9. What are your rights?

Users of CotizUp services have rights of access, modification, rectification, and deletion of data concerning them, which they can exercise with CotizUp either by mail to: CotizUp, C/o Pod 2, The Ole Station House, 15a Main Street, Blackrock, Dublin, Ireland, or by email by following https://www.cotizup.com/contact.

Furthermore, CotizUp never collects, processes, or stores users' bank card details, which are known only by its banking partner.

10. Right of access

You have the right to access data concerning you. If you exercise this right, CotizUp will provide a copy of the characteristics of the processing carried out on your data. This information will be provided on a commonly used electronic medium. CotizUp may require payment of fees based on administrative costs generated by any request for additional copies.

11. Right of rectification

If you find that data concerning you is inaccurate or incomplete, you may request rectification or update of that data. You can modify certain identification data directly from your CotizUp profile.

12. Right of erasure

If you have a legitimate reason, you may object to your data being processed. Once you object, your data will no longer be processed for those purposes.

When your personal data (especially your email address) is used for marketing or commercial communication, you may object at any time by contacting CotizUp. Once you object, your data will no longer be processed for those purposes. You may also unsubscribe from marketing or commercial emails using the unsubscribe link available at the end of each such email.

14. Jurisdiction and applicable law

These Terms are governed by Irish law. Except where mandatory law applies, and only to the strict extent of its purpose, it is expressly stipulated that in case of disputes related to interpretation, validity, and consequences of these Terms and absent an amicable prior solution, Dublin courts shall have exclusive jurisdiction.

15. Non-transferability

The contract may not be assigned in whole or in part by the user, whether for value or free of charge. It is therefore prohibited to transfer to a third party any rights or obligations arising from these terms. In case of breach of this prohibition, in addition to immediate termination of these terms, the user's liability may be engaged by CotizUp.
