Freedom of expression in danger at Collège de Bourtzwiller Mulhouse
Social and union conflicts in a school establishment are not meant to end up in court and even less so when it comes to condemning the collective action of staff.
Since 2021, the Collège de Bourtzwiller in Mulhouse has been the scene of a conflict between staff and the headteacher over the issue of suffering at work, notably generated by the management of the administration.
In June 2021, after not being heard following several warnings, staff organized an action outside the school which the local press reported on.
In response, the rectorate launched a 360° inquiry to establish a diagnosis.
Even while this inquiry was ongoing, the headteacher filed a defamation complaint against only 4 of the 25 teachers who had taken part in the collective action in front of the school.
His complaint having been dismissed by the Mulhouse public prosecutor, the headteacher then took the initiative of suing our 4 colleagues in civil court.
At the end of two years of a long and exhausting procedure, the court ordered our 4 colleagues to pay damages and part of the legal costs for a sum of nearly 6.000 euros, which the headteacher demanded be paid immediately. To this amount are added lawyers' fees.
The colleagues have decided to appeal: this concerns the freedom of expression of staff. It also concerns the duty to alert as defined in public service law to express the refusal of suffering at work. Finally, it concerns the trade union right to be able to act in the defense of staff and the public education service.
